Campbell Law wins appeal in nationwide class action against American Express 

 

The California Court of Appeals ruled unanimously on Friday July 6, 2007 that American Express could not force claims for tens of millions of dollars in refunds to arbitration because it intentionally misled class members and the California Courts. In the ruling, the Court made clear that since American Express tried to use the Courts to cheat its customers in a national class action settlement that was based on intentionally false information that its in-house lawyers supplied, and false information the company itself supplied, it could not now deny the customers their day in the same court.


Tom Campbell serves as the Vice-Chair of the Plaintiffs Steering Committee in the six-year-old litigation.  Trial should take place within the next year unless the parties agree to a new settlement which provides more relief to the class members. According to Campbell, "Amex really has it back against the wall now.  It tried to cheat the class members in the California Courts and wiggle out when we caught them. Now it is time to beat Amex in the same Courtroom. We expect a jury will hold them to account."
